Regulations of the online store: www.tomwer.com.pl/sklep

  1. The TOMWER online store operating at the Internet address www.tomwer.com.pl is run by:
    TOMWER Cieślar Tomasz, ul. Branców 12, 43-460 Wisła, NIP: 548-242-93-93: Regon 362373048

The terms used in the Regulations mean:

  1. Customer - a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by special provisions, who places an Order in the Store.
  2. Civil Code - Act of April 23, 1964 (Journal of Laws 1964, No. 16, item 93, as amended).
  3. Regulations - these Regulations for the provision of electronic services within the online store https://tomwer.com.pl/sklep/
  4. Online store https://tomwer.com.pl/sklep/ – website available at https://tomwer.com.pl/sklep/, through which the Customer may, in particular, place Orders;
  5. Goods – products presented in the Online Store.
  6. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between TOMWER and the Customer, concluded using the Store's website.
  7. Act on Consumer Rights - Act of May 30, 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended).
  8. Order - the Customer's declaration of will, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.

General provisions.

  1. These Regulations define the rules for using the online store available at https://tomwer.com.pl/sklep/Online store, operating at www. https://tomwer.com.pl/sklep/, is run by TOMWER, ul. Branców 12 43-460 Wisła, NIP: 548-242-93-93 REGON: 362373048
  2. These Regulations specify in particular:
    1. rules for registering and using the account in the online store;
    2. terms and conditions for making electronic reservations for products available in the online store;
    3. terms and conditions for placing Orders electronically in the online store;
    4. rules for concluding Sales Agreements using the services provided within the Online Store.

Rules for using the online store.

  1. Purchasing a Product does not require registration in the Store.
  2. The information provided on the Store's website, including information about the products presented, in particular their descriptions, technical and operational parameters and prices, constitute an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.
  3. Placing an order is done using the form available on the store's website.
  4. Each customer registering and/or placing an order agrees to receive information related to the course of the transaction and notifications of changes to these Regulations to the e-mail address provided by him/her.
  5. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.

Procedure for concluding a Sales Agreement

  1. In order to carry out any activity of the Customer in the Store, the correct operation of the Internet, the use of a web browser, including on mobile devices, and an active account at the selected e-mail address are required.
  2. In order to conclude a Sales Agreement via the Online Store, please visit the website www. https://tomwer.com.pl/sklep/ make a choice by taking further technical steps based on the messages displayed to the Customer and the information available on the website.
  3. The store allows you to purchase products and services 24 hours a day, 7 days a week.
  4. The Customer selects the Goods ordered by adding them to the cart.
  5. When placing an Order - until the "Place an order" button is pressed - the Customer has the opportunity to modify the entered data and the selection of the Goods. For this purpose, please follow the messages displayed to the Customer and the information available on the website.
  6. To finalize the order, the Customer is asked to provide all the necessary data needed to complete the order, i.e.
    1. name and surname / company name
    2. delivery address
    3. e-mail
    4. phone number
    5. NIP – in case of requesting a VAT invoice.
  7. After the Customer using the Online Store provides all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information regarding:
    1. subject of the order,
    2. unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
    3. selected payment method,
    4. selected delivery method.
  8. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Place an order" button.
  9. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with TOMWER, in accordance with the Regulations.
  10. After placing and paying for the Order, the Customer receives an e-mail entitled "Order Confirmation", containing final confirmation of all important elements of the Order.
  11. The contract is deemed concluded when the Customer receives the e-mail message referred to above.
  12. The sales contract is concluded in Polish, with content consistent with the Regulations.

Deliveries in the online store.

  1. The prices of products in the Store are given in Polish zlotys, they include tax and exclude shipping costs. Shipping costs are added to the total amount of products ordered and are borne by the customer. The final price, binding for the Owner and the Customer, is the price of the product given in the offer at the time of placing the order by the Customer.
  2. Delivery types and prices:
    1. INPOST cash on delivery: PLN 26 / delivery time 1-2 business days
    2. INPOST transfer: PLN 20 / delivery time 1-2 business days
    3. INPOST parcel locker PLN 20 / delivery time 1-2 business days
    4. personal pickup at the store in WISŁA
  3. Information on the total value of the order (including shipping costs, which are detailed in the Delivery and returns tab) is available in the Order Summary on the product sales page and in the order confirmation.
  4. Delivery of Goods takes place both within the Republic of Poland and European countries and selected countries located on other continents to the address indicated by the Customer when placing the Order.
  5. Delivery of the ordered Goods takes place by courier.
  6. The delivery deadline for orders delivered within the territory of the Republic of Poland is three business days from the date of payment for the Order by the Customer. For orders with delivery outside the Republic of Poland, the delivery date is given with information regarding the form of delivery and the country of destination.
  7. Together with the shipment, the Customer will receive a printout of confirmation and specifications of the Order, as well as proof of sale. At the express request of the Customer, a VAT invoice may be issued.

Prices and payment methods in the online store.

  1. The prices of the Goods are given in Polish zloty and include all components, including VAT. The customer has the option of paying the price:
    1. by transfer to the bank account number PL 69 1050 1096 1000 0090 9316 5646;
    2. payment in the system, PayU;
    3. payment by payment card: VISA, Master Card.

Withdrawal from the contract.

  1. The customer who is a consumer within the meaning of Art. 22 of the Civil Code, you have the right - pursuant to legal provisions - to withdraw from a contract concluded remotely, without giving a reason, by submitting an appropriate declaration in writing or by e-mail to biuro@tomwer.com.pl, within 14 days and sending it to the following address: COMPANY NAME provided in these Regulations.
  2. In the event of withdrawal from a distance contract, the contract is considered not concluded. What the parties have provided is returned unchanged. The return should be made immediately, no later than within 14 days. The purchased goods should be returned to the following address: TOMWER ul. 43-460 Wisła Ul. Branców 12
  3. The Goods returned by the Customer should be packaged in an appropriate manner to ensure that the shipment is not damaged during transport.
  4. In the event of withdrawal from this contract, the store will refund to the customer all payments received from him, including the costs of delivering the items (except for additional costs resulting from the delivery method chosen by the customer other than the cheapest delivery method offered by the store), immediately, no later than 14 days from the day on which the goods were returned. The refund will be made using the same payment methods used by the Customer in the original transaction, unless the parties agree otherwise.

Returns and complaints policy in the online store.

  1. If the purchased product is inconsistent with the contract or has physical defects, the Customer has the right to submit a complaint based on:
    1. regulations provided for in the Act of July 27, 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended), if the product is inconsistent with the contract,
    2. regulations provided for in the Civil Code regarding warranty for defects.
  2. In order to submit a complaint, the Customer is obliged to inform the store by e-mail to biuro@tomwer.gmail.com and then proceed in accordance with the information received.
  3. When specifying demands based on the procedure provided for in Art. 1 section a) The customer has the right to request that the product be brought into compliance with the contract by free repair or replacement, unless the repair or replacement is impossible or requires excessive costs. If the Store is unable to meet specific requests, the Customer has the right to demand an applicable price reduction or may withdraw from the contract.
  4. When specifying demands based on the procedure provided for in Art. 1 section b) The customer has the right to withdraw from the contract or demand a price reduction. The Customer may not withdraw from the contract if the Store immediately, no later than within 14 days, replaces the defective item with a defect-free item or immediately removes the defects. This limitation does not apply if the item has already been replaced or repaired by the Store, unless the defects are insignificant.
  5. The store is liable for non-compliance of the consumer product with the contract (Article 1(a)) only in cases and under the conditions specified by law.
  6. The store is liable for product defects under the warranty (Article 1(b)), in the cases and under the conditions specified by law.
  7. The Store considers complaints within 14 days from the date the Store receives the complaint along with the complete complained product.
  8. The store reserves the right to refuse to accept a complaint in the event of any modifications to the product by the Customer.
  9. The store reserves the right to refuse to accept complaints in cases of: exclusive fault of the user, mechanical damage, improper maintenance and use of the product inconsistent with the instructions.
  10. If the complaint is accepted, the shipping costs of the complained product will be refunded to the Customer within 14 days from the date of acceptance of the complaint.

Privacy and personal data policy and their protection.

  1. The condition for finalizing purchases in the Store is to provide all the Customer's data required by the content of the form and to select the appropriate box (checkbox) constituting the Customer's consent to the processing of his personal data by the Owner and the field (checkbox) confirming familiarity with and acceptance of these Regulations.
  2. All Customer data provided during registration in the Store will be used only for the purpose of implementing, amending or terminating the Agreement or other marketing activities, in particular informing about new products and services of the Store, provided that the Customer consents by checking the appropriate box (checkbox) to sending commercial information, using electronic means of communication within the meaning of the new Regulation (EU) 2016/679 of the European Parliament and of the Council of 27/04/2016.
  3. All personal data of the Customer will be processed by the Owner in accordance with the provisions of the Act referred to above.

  5. Only personal data provided voluntarily by the Customer is collected. The data is processed for the purpose necessary to implement the provisions of these Regulations, in particular concluding a contract for the sale of the ordered goods, delivering the goods for which the customer has placed an order to the customer, issuing a document confirming the transaction of sale of the goods, storing personal data in the IT accounting system to ensure the history of commercial transactions made via the Store.
  6. The data provided when placing an order is also processed by the following entities to the extent specified: name and surname, address, telephone number, e-mail address indicated as the delivery address are transferred to shipping companies in the form of a label/waybill, which is also an order to deliver the shipment. Depending on the selected type of shipment, the following are delivered:
    1. DELIVERY MAN
    2. INPOST
  7. The data is also processed by entities related to the payment for the order:
    1. ING BANK
    2. PayU
  8. The data administrator is not responsible for providing false or incomplete personal data by the Customer.
  9. The Customer has the right to change, correct or delete his or her personal data at any time through the Store's service office.
  10. With additional consent granted by the Customer, the collected personal data may also be used for promotional and marketing purposes, in particular to present the Customer with the store's commercial offer and other marketing information related to the Store.
  11. Each user has the opportunity to subscribe to the newsletter - commercial information. Signing up for the list is done by checking the appropriate box in the form at the registration stage (only an e-mail address is needed for this purpose). You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by informing the Store by e-mail to biuro@tomwer.com.pl. After cancellation, your e-mail address will be immediately deleted from the subscription database.
  12. The store uses, among others, so-called "cookies", which contribute to greater usability, functionality and ease of use of our store. These instruments also make it easier for Customers to navigate the Store's website faster. Additionally, cookies allow us to measure the frequency of page views and the most frequently viewed products. Cookies are small text files that are stored on your computer system. Please be advised that some of these files are transferred from the Store's server to the Customer's computer system. You can block cookies at any time, provided that the browser you use has the appropriate function. Please remember that after blocking cookies, the ability to use some functions of the Store will be significantly limited or disabled.

Final Provisions.

  1. All content contained in the Store is subject to legal protection and their use will constitute a violation of the law.
  2. In matters not regulated in these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the provisions of the Act on special conditions of consumer sales and amendments to the Civil Code of July 18, 2002 (Journal of Laws 2001, No. 144, item 1204) and the provisions of the Act on consumer of May 30, 2014 (Journal of Laws of 2014, item 827, as amended); and other relevant provisions of generally applicable law.
